CASE: The Hunt for Seasonal Workers Crosses Borders
Introduction
Generally speaking, when the subject of seasonal workers comes up, most people think about agricultural positions. Many don’t take into consideration the hundreds of tourist attractions and resorts that must increase their staff during peak seasonal times. Traditionally these roles were filled by high school and college students (Noe, Hollenbeck, Gerhart, & Wright, 2009), however this is no longer the case. Many of these companies have resorted to H-2B Visa holders from foreign countries to fill their open seasonal positions. But with recent government changes, the amount of workers a company can use with H-2B’s has changed, forcing them to come up with yet another solution to their seasonal staffing problems.

Review/Analysis of the Case
Companies such as High Sierra Pools and the Broadmoor Hotel rely heavily on filling their seasonal staff with foreign workers who use an H-2B Nonagricultural temporary work Visa. Meaning they have to return back to their home country after working a maximum of six months in the US. A temporary provision allowed returning seasonal workers back every year without affecting the cap of 66,000 new Visas issued every year. That provision has thus expired and now it is only a total of 66,000 new and returning workers that are granted a new H-2B Visa every year (Noe, et. al., 2009). This dramatically affects companies such as High Sierra, who employ up to 250 seasonal workers a year, in that they cannot rely on their already trained return workers will be able to come back.
